Terms of Service

1. Agreement
These Terms of Service (the “Terms”) govern your access to and use of GetViral (the “Service”), operated by Firebrain, LLC(“Firebrain,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
GetViral is an AI-assisted short-form video editor that lets you upload source media and generate edits, captions, and other derivatives using natural-language prompts. We may add, change, or discontinue features at any time.
3. Accounts
You must provide accurate information when creating an account and are responsible for activity that occurs under it. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. Keep your credentials secure and notify us at david@getviral.cc if you suspect unauthorized access.
4. Your Content
You retain all ownership of the media, prompts, and other content you submit to the Service (“Your Content”). You grant Firebrain a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and modify Your Content solely to operate, secure, and improve the Service. You represent that you have all rights necessary to grant this license and that Your Content does not infringe any third-party rights or violate any law.
5. Acceptable Use
You agree not to use the Service to:
- upload content you do not have the right to use;
- create content that is unlawful, defamatory, harassing, sexually explicit involving minors, or that promotes violence or hate;
- impersonate any person or misrepresent your affiliation with anyone;
- attempt to reverse engineer, scrape, overload, or otherwise interfere with the Service or its infrastructure;
- use the Service to train or fine-tune a competing machine-learning model.
6. Subscriptions & Billing
Paid plans renew automatically until cancelled. You authorize us (and our payment processor) to charge the payment method on file at the start of each billing period. Fees are non-refundable except where required by law. We may change pricing on at least 30 days’ notice; changes apply to billing periods beginning after the notice period.
7. Intellectual Property
The Service, including its software, design, and trademarks, is owned by Firebrain, LLC and its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you. Feedback you provide may be used by us without obligation.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if continued provision is no longer commercially viable. Sections that by their nature should survive termination (including Sections 4, 7, 9, 10, and 12) will survive.
9. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Firebrain disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. AI outputs may be inaccurate or unsuitable; you are responsible for reviewing them before publication.
10. Limitation of Liability
To the maximum extent permitted by law, Firebrain, LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the greater of (a) the amounts you paid to us in the twelve months before the claim and (b) one hundred U.S. dollars.
11. Indemnification
You agree to indemnify and hold Firebrain, LLC harmless from any claim or demand, including reasonable attorneys’ fees, arising out of Your Content, your use of the Service, or your violation of these Terms or any law.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You and Firebrain waive any right to a jury trial.
13. Changes to These Terms
We may update these Terms from time to time. If a change is material, we will notify you (for example, by email or in-product notice) before it takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
